What is an IA?

An Initial Appearance is the first time a Defendant goes before a judge. If the person is in custody, an Initial Appearance must be held within 24 hours of their arrest. The Maricopa County Superior Court Initial Appearance Court is held downtown at the 4th Avenue Jail every day of the week and they are held every three hours- 2 a.m., 5 a.m., 8 a.m., 11 a.m., 2 p.m., 5 p.m., 8 p.m., and 11 p.m.

If someone has not been arrested, but has received a Summons to appear for an Initial Appearance, the hearing is usually held on a Wednesday, Thursday or Friday afternoon at the South Court Tower in downtown Phoenix.

Whether a person is in or out of custody, the Initial Appearance is a time for them to be formally informed of the charges against them and enter a not guilty plea. The judge will advise them of their right to an attorney and if they cannot afford an attorney, one may be appointment at that time. Release conditions are also set at the Initial Appearance. Release conditions can range from being released on your own recognizance or to pretrial services, a bond being set or being held non-bondable. You will also receive a new court date at this hearing.
